Top Moments ("Company", "we", "our", or "us") respects the intellectual property rights of others and expects users of our services to do the same.

In accordance with the Digital Millennium Copyright Act ("DMCA"), Top Moments will respond to properly submitted claims of copyright infringement.

If you believe that material distributed through our Service infringes your copyright, you may submit a DMCA notice as described below.

1. Content Distributed by Top Moments

Top Moments provides services that involve:

  • Editing short-form video clips
  • Formatting content for social media
  • Distributing clips across social media platforms
  • Publishing clips through accounts operated by Top Moments or by clients

Content used for these purposes may be provided by clients or derived from publicly available streams or recordings.

Clients are responsible for ensuring they have the legal rights to any content submitted to the Service.

2. Submitting a Copyright Infringement Notice

If you believe your copyrighted work has been used without authorization, you may submit a DMCA takedown notice.

Your notice must include the following information:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, including the specific URL or location where the content appears.
  4. Your contact information, including:
    • Full name
    • Mailing address
    • Telephone number
    • Email address
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Incomplete notices may not be processed.

3. DMCA Notice Submission

Upon receipt of a valid notice, we may:

  • Remove or disable access to the allegedly infringing content
  • Notify the party responsible for the content
  • Take further action if necessary

4. Counter Notification

If you believe content was removed in error, you may submit a counter-notification.

Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the removed material and its previous location
  3. A statement under penalty of perjury that you believe the material was removed due to mistake or misidentification
  4. Your contact information
  5. A statement consenting to the jurisdiction of the federal court in your district

5. Repeat Infringers

Top Moments reserves the right to terminate service for users or clients who repeatedly violate copyright laws or submit infringing material.

6. Platform Takedowns

Content distributed through Top Moments may appear on third-party platforms including:

  • YouTube
  • TikTok
  • Instagram

If content appears on these platforms, copyright holders may also submit takedown requests directly through the platform's reporting systems.

Top Moments is not responsible for decisions made by third-party platforms regarding content removal or account enforcement.

7. Client Responsibility

Clients using Top Moments services represent and warrant that they have the legal rights to any content submitted or accessed for clipping, editing, or distribution.

Clients agree to indemnify and hold Top Moments harmless from any claims arising from copyright infringement or unauthorized content use.

8. False Claims

Submitting false or misleading copyright claims may result in legal liability under applicable law.

Top Moments reserves the right to pursue legal remedies for abuse of the DMCA process.
